Well, Symbolics.com is still selling licenses of Open Genera, so chances are you won't be able to Open Source it. Of course, the situation is only worse if Open Genera includes third party code itself available only under restrictive licenses... The french Lisp implementation Ilog Talk died this way: cleaning up the code to make it publishable cost more than the company was ready to afford.
